GUIDANCE DEPARTMENT
I. JUSTIFICATION
In compliance with the 6th article of our statutes, the Foundation's MISSION is to render social and integral care services to people with chronic mental disorders. This is a task which is carried on in three areas, and the first is guidance entity, which assumes and exercises tutelary duties commended by the judicial authorities to people with mental disorders.
Thus the GUIDANCE DEPARTMENT constitutes the foundation for the institution, and its mission being the facilitation of legal protection to all the people suffering from severe and persistent mental disorders commended by the judicial authorities, the search for and management of resources as a means to allow users to obtain the maximum level of autonomy and integration in their community, as well as the legal defense for their interests.
II. SCOPE
The guidance service becomes necessary once FUNDACION MANANTIAL, by legal designation and in compliance with its statutes, assumes any of the following duties with a person:
That of LEGAL DEFENSOR, whose mission is to see to it that capacity-revision procedures are carried on in compliance with the law, providing proof leading to determining the scope of the illness and its repercussions, as well as presenting specific facts to the Legal Authorities and the Attorney General concerning the individuals whose protection or patrimony is being requested.
The duty of PROVISIONAL ADMINISTRATOR assumed by FUNDACION MANANTIAL when when it becomes necessary to adopt measures to defend the patrimony of the defendant during a legal procedure.
The duty of GUIDE and GUARDIAN, of a permanent nature, as long as it is in compliance with the law, and it performs the functions of protection and guardianship of the defendant.
IV. EXERCISE OF GUIDANCE DUTIES
The exercise of guidance duties will be performed in the following areas:
a) Legal Attention
• Acceptance of individuals in need of Guidance and Guardian commended by the legal authorities; Legal Defense, Provisional administration of the defendant's assets, provided the defendant is a person suffering from mental disorders.
• Defense of the defendant's legal interests in all procedures legal, civil, penal, administrative or occupational that may exist.
• Exercise of direct legal action to protect the defendant's interests, both personal and financial.
• Defending his inheritable assets, intervening in partition procedures.
• Legal authorizations to comply with civil legislation.
• Taking inventories.
• Paying due attention to judicial requirements.
These activities are executed by the professionals belonging to the Legal Services Area
b) Psychosocial Care
When taking care of a person it is important to create an environment of trust, collaboration and guidance, keeping the person informed of all the steps which have been taken and making him, in as much as possible, a part of the decision-making process. This is an important part of the success achieved at the time of attaining one of the objectives sought after by the program: obtaining the maximum level of autonomy and social integration. The objectives of the guidance department are:
• Informing and assessing the patient about his rights guiding or serving as guardian.
• Elaboration of an individualized intervention plan summarizing the user's problem areas as well as his expectations and goals.
• Search and acquisition or resources: residential, occupational and economic.
• Coordination with the pertinent assistance bureaus or departments in order to establish a relation of collaboration as a means of attaining the planned objectives.
• Favor the adherence to the regulations concerning pharmacological treatments and psychosocial intervention, prescribed by Mental Health Centers.
• Support for accessing communitarian resources.
• Social and affective support for users.
• Supporting daily tasks to promote the individual's permanence in his regular environment.
• Family coordination and help to foster and promote the planning and attainment of programmed objectives.
This aspect of guidance is carried on by the professionals working in the Social Services and Intervention Area.
All of the individuals whom we serve as guardians or to whom we provide guidance have a REFERENCE
PROFESSIONAL, who may well be a Social Worker, or any of the Social Educators, in cases in which this was a
part of our Program for improving the integration to the community.
c) Patrimonial Care
• Elaboration of individualized financial plans.
• Income management.
• Petition, acquisition, rehabilitation of the collection of pensions and other types of assistance.
• Proper payment of taxes.
• Formalization of inventories.
• Preparation of an annual income statement.
These activities are carried outby professionals working for the Financial-Administrative Care Area.
V. AGREEMENTS
• Madrid Agency for the guidance of adults
In October 2001, a collaboration agreement was signed with the Madrid Agency for the Guidance of adults (AMTA), by
which we have assumed the socio-communitarian intervention and residential care of 25 people with chronic
mental disorders under the protection of this entity.
The importance of this agreement and the high levels of satisfaction of both sides resulting from its development,
require an additional chapter in this Memoir.
• Madrid Agency for Guidance of Adults
Since 2004 there's an agreement between AMTA and FUNDACI0N MANANTIAL whose double objective is to obtain profits from administered fixed assets which would allow possible for their patients to have a decent home.
• IES-JULIO VERNE Educational Center.
It is a a collaboration agreement for the development of the professional training unit for Formative period and Formative practices at the Employment Center. In the year 2007, two students in the Formative Period of Social integration collaborated with the department for the development of this agreement.
VI. PROGRAMS
The programs which have been set in motion by the Guidance Department during the year 2007 are the following:
• PROGRAM FOR THE IMPROVEMENT OF FINANCIAL ADMINISTRATION.
This program was created with the purpose of teaching our wards the correct use of their financial resources and improving their integration into the community, A savings account would be opened under their name being their own responsibility, so the ward would go to the bank and withdraw funds from the bank clerk or ATM machine. The amounts withdrawn from the avalaible total deposited would be what they need on a weekly basis. The program has been so successful that it has become the norm for the administration of our wards' pocket money, as the benefits are not just the ones already stated, but also include agility, efficiency and transparency.
Ninety two savings accounts were opened in 2007.
• PROGRAM FOR WARDS IN NEED OF SPECIAL CARE.
It focuses on wards with either a precarious situation or one with a high personal, social or financial risk, which translates into a need for greater supervision and follow-up, involving all the professionals in the department.
During the year 2007, fifteen of our wards were in this program, which on three occasions prevented their involuntarily hospitalization.
• PROGRAM FOR THE IMPROVEMENT OF INTEGRATION TO THE COMMUNITY.
It focuses on wards living in either their own homes, their relatives' homes, or in supervised apartments, and who have been assigned to one of the Social Workers or Social Integrators of the Department as their PROFESSIONAL REFEREE. The aim is of working, wards would be in their own homes and social environment in order to improve social skills, personal autonomy level, integration to the community and personal hygiene standards.
During 2007 ninety-one wards were assigned to one of our Social Educators as Professional Referees.
· GUIDED PATRIMONY INVESTMENT PLAN.
With the purpose of turning our ward's financial assets into profitable ones, an asset-investment plan by segments was put into practice through our Financial-Administrative Area in 2007. To this end cash assets were categorized in three segments:
1. Wards with a Financial Patrimony < 3.000.-€.
We consider it necessary to have this amount available, thus leave it in the ward's current or savings account.
2. Wards with a 9.000.-€. > Financial Patrimony >3.000.-€
.
We leave up to 3.000.-€ in their current or savings account (Segment 1) and the rest is transfered
to an Insured Investment Fund up to a limit of 6.000.-€. May there be a need for these funds, they would be
available one day after the order for reimbursement of the funds has been placed.
3. Wards with a Financial Patrimony > 9.000.-€.
We leave
up to 3.000.-€ in a current or savings account, and invest up to 6.000.-€ in an Insured Investment Fund.
The remaining portion of the funds is invested on fixed-term deposits, and never any longer than three years. These
are only on interest-yielding financial products (according to current market conditions), having all profits deposited
in the current or savings account.
• STATISTIC DATA OF THE DEPARTMENT
The information shown below refers to the 132 charges exercised by FUNDACION MANANTIAL until December 31, 2007, NOT including the 25 individuals whose socio-communitarian and residential support have been assumed by the Foundation after signing the agreement with AMTA.
